Web Hosting Terms of Service

Last updated: August 30, 2026
Provider: 911-PcDoc (Marc Wallace), 911pcdoc.com
Applies to: All web hosting, email, storage, static IP, and related services (“Services”) provided to the customer (“Customer”).

By activating a Service, Customer agrees to these Terms. If Customer does not agree, the Service must not be used and Customer must cancel before the first billing cycle closes.

1.Services & Plans

1.1 Hosting plans are offered as Spark ($10/month) and Business ($25/month), billed in terms of 1, 3, 6, or 12 months at the rate × term (e.g. Business 12-month = $300).

1.2 Add-on services: Extra Mailbox ($2/mailbox/month), Extra Storage ($5 per 5 GB/month), Static IPv4 ($17/month), Static IPv6 ($17/month), Backup Setup ($90 one-time), Tech Support ($90/hour).

1.3 Prices are set in the Provider’s Square catalog and are the sole source of pricing. Provider may change prices on renewal; the then-current catalog price applies to the next term.

1.4 Static IP addresses include Provider-managed reverse DNS (rDNS/PTR) to support email deliverability. Email deliverability is best-effort and not guaranteed; Provider is not liable for messages filtered or rejected by third-party networks.

1.5 Provider may relocate, re-architect, or route Services through intermediary infrastructure (including encrypted site-to-site tunnels between facilities) at its sole discretion. Such changes do not constitute a breach and require no prior notice beyond what this Agreement states.

2.Billing & Payment

2.1 Invoices are issued via Square and are due within 7 days of the invoice date (“Due Date”).

2.2 Customer authorizes Provider to bill the payment method on file for the full term selected at signup. Renewal occurs automatically at term end unless cancelled 14 days prior.

2.3 All fees are exclusive of applicable sales tax, which is added at checkout.

3.Late Payment & Late Fees

3.1 A grace period of 7 days applies after the Due Date. No penalty accrues during the grace period.

3.2 If an invoice remains unpaid after the grace period, a flat late fee of $15.00 per billing cycle is added to the Customer’s account. The late fee is charged once per cycle and does not compound daily.

3.3 The late fee applies to every subsequent cycle until the account is paid current. The plan rate continues to accrue normally during delinquency.

4.Storage Hold, Access Freeze & Data Retention

4.1 Provider reserves storage space, configuration, and customer data (“Held Data”) on Customer’s behalf even when an account is delinquent.

4.2 At 30 days past the Due Date with no payment, the account is placed on Storage Hold: Customer’s access (control panel, FTP, email delivery, public site) is frozen, but the Held Data is retained and the normal plan rate plus any late fees continue to accrue monthly.

4.3 Storage Hold is not a cancellation. Customer may cure the delinquency at any time during the hold by paying all owed amounts in full, including the plan rate for elapsed held months and any late fees. Upon full payment of all past-due charges, the account will be reactivated and access restored within 30 to 45 minutes. This window allows for processing time and any unforeseen system malfunction; restoration may be faster but is not guaranteed sooner.

4.4 Provider does not delete, sell, or disclose Held Data during the hold. Held Data remains Customer’s property.

5.Termination for Non-Payment

5.1 If an account remains unpaid at 90 days past the Due Date, the Service is terminated under this Agreement.

5.2 Upon termination under §5.1, Provider may purge all Held Data with no further obligation to retain, return, or recover it. Customer is responsible for exporting data before termination.

5.3 Termination under this section does not forgive owed balances. Provider may pursue collection of unpaid plan rates and late fees.

6.Acceptable Use

6.1 Customer may not use the Services for illegal activity, spam, malware distribution, or resource abuse that degrades service for others.

6.2 Provider may suspend (not terminate) a Service immediately for active abuse, pending investigation.

7.Liability

7.1 Services are provided “as is” and on a best-effort basis with no uptime SLA. All fees are prepaid and non-refundable. Customer acknowledges that web hosting is a communications service under Florida law, and that this prepaid service agreement is enforced under Florida contract law. Provider is not liable for data loss, downtime, business interruption, or service unavailability — including outages caused by upstream, transit, last-mile, or customer-premise connectivity failures, hardware failure, or maintenance.

7.2 Provider’s total liability is limited to fees paid in the prior 3 months.

8.Termination by Customer

8.1 Customer may cancel any time with 14 days’ notice before term end. No refund for partial months unless required by law.

9.Changes

9.1 Provider may update these Terms; continued use after notice constitutes acceptance.

10.Electronic Signature & Payment Authorization

10.1 At signup, Provider obtains a pre-authorization (hold, not a charge) on Customer’s payment card for the full amount of the selected plan and term (e.g. Business 12-month = $300). No funds are captured until Customer signs this Agreement.

10.2 By electronically signing this Agreement through Provider’s signature process (Docuseal), Customer authorizes Provider to capture the pre-authorized card payment for the full term selected at signup. This signature constitutes Customer’s executed authorization for that credit card transaction and for the recurring charges described in Sections 1–2. Signing is equivalent to signing the associated credit card receipt.

10.3 Upon signature, Provider captures the pre-authorized amount and provisions the Service. If Customer does not sign, the pre-authorization is cancelled and no charge occurs.

By signing this Agreement, Customer accepts these Terms in full — including the late-fee, Storage Hold, and 90-day termination provisions in Sections 3–5 — and authorizes the capture of the pre-authorized card payment for the selected plan and term under Section 10.

Signature is collected electronically at signup.
Signing happens through our secure signature process, after your plan is selected.
